1. Introduction

Welcome to De Leon Tax Services LLC (“De Leon Tax Services,” “we,” “our,” or “us”). These Terms & Conditions govern your access to and use of:

  • The public website deleontax.com

  • The secure client portal hosted by Canopy Tax at deleontax.clientportal.com

  • Scheduling systems provided through Calendly

  • Payment processing via Stripe (external payments) and Adyen (portal payments)

  • All tax, bookkeeping, consulting, and related professional services offered by De Leon Tax Services LLC

By using any of these services, you agree to these Terms & Conditions.

2. Scope of Services

We provide the following services:

  • Individual and business tax preparation

  • Amended and prior-year tax return services

  • Bookkeeping and payroll support

  • Nonprofit consulting, compliance, and financial guidance

  • Notary services

  • Document preparation and related advisory services

Some services may require separate agreements or disclosures as required by federal or state law.

3. Distinction Between Website, Portal, and Third-Party Tools

3.1 Public Website (deleontax.com)

Our Squarespace-hosted website provides public information, intake forms, and scheduling.
Sensitive tax documents should not be uploaded through general website forms.

3.2 Secure Client Portal (Canopy Tax)

Your confidential documents are uploaded, stored, and exchanged through Canopy Tax at:

https://deleontax.clientportal.com

The portal is used for:

  • Secure messaging

  • File sharing and uploads

  • E-signatures

  • Invoicing and payments

  • Document delivery and task tracking

3.3 Scheduling (Calendly)

Appointments are booked using Calendly. Calendly collects minimal contact data for routing purposes.
Scheduling an appointment does not establish a preparer–client relationship.

3.4 Stripe (External Website Payments)

Payments made outside the portal—such as on our website or via emailed payment links—are processed securely through Stripe.

3.5 Credit Card Payments in Portal (Adyen)

Credit card payments made within the client portal are processed by Adyen, the payment processor used by Canopy.

4. User Responsibilities

You agree to:

  1. Provide complete, accurate, and timely tax and financial information.

  2. Upload all sensitive documents only through secure tools such as Canopy.

  3. Review all drafts, tax returns, and documents before signing.

  4. Maintain personal copies of your tax returns and financial documents.

  5. Notify us promptly of any changes to your information.

  6. Use secure, updated devices when accessing the client portal.

Delays or inaccuracies in your information may affect return preparation or filing.

5. Professional Relationship

A preparer–client relationship is officially established only when:

  • You sign an engagement letter or consent to prepare, and

  • You upload or provide the necessary tax documents.

Communication or appointment scheduling alone does not establish a professional relationship.

6. Payment Terms

6.1 Service Fees

Fees vary depending on service type, tax complexity, business needs, or nonprofit requirements. Fees will be disclosed before filing or releasing documents.

6.2 Invoice Requirements

Invoices must be paid in full prior to release or filing of:

  • Tax returns

  • Bookkeeping reports

  • Nonprofit deliverables

  • Financial documents

  • Any prepared materials

6.3 Late Fees

Invoices that are unpaid past their due date are subject to a late fee of up to 4% of the outstanding balance, which may be charged monthly until the balance is paid.

6.4 Processing Fees

Processing fees may apply depending on the payment method used (Stripe, Adyen, or other processors).
These fees are set by the payment processors and are non-refundable.

6.5 Refund Policy

All fees are non-refundable once work has been completed, provided, or filed, including situations where:

  • Tax outcomes differ from expectations

  • The IRS or state delays or adjusts refunds

  • Credits or deductions are denied or modified

  • You choose not to file after work is completed

7. Compliance With Federal and State Regulations

We comply with multiple confidentiality and security laws and guidelines, including:

  • IRS Publication 4557 (Safeguarding Taxpayer Data)

  • Gramm–Leach–Bliley Act (GLBA) Safeguards Rule

  • California Consumer Privacy Rights Act (CCPA/CPRA) where applicable

These regulations govern data security, access controls, retention, disposal, and safe handling of taxpayer information.

8. Data & Document Storage

We maintain digital and physical records using:

  • Canopy Tax encrypted cloud storage

  • Local office computers secured by encryption, strong passwords, and multi-factor authentication

  • Paper records stored onsite in restricted-access locations

  • Squarespace Analytics and Umami for non-PII website analytics

  • Tidio chat for website support

We do not store tax returns or sensitive documents on Squarespace, Calendly, Tidio, Umami, or other non-secure tools.

9. Intellectual Property

All website content, documents, branding, and materials created by De Leon Tax Services LLC are protected intellectual property.
You may not reproduce, distribute, or modify our content without written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not responsible for errors caused by incomplete or inaccurate information submitted by clients.

  • We are not liable for financial outcomes, refund delays, audits, adjustments, or penalties assessed by tax authorities.

  • We are not responsible for interruptions or errors caused by third-party services such as Canopy Tax, Stripe, Adyen, Calendly, Squarespace, Tidio, or Umami.

  • Service use is at your own risk.

11. Third-Party Integrations

You acknowledge that our workflows rely on third-party services for scheduling, payments, secure storage, and communication.
Each third-party provider operates under its own policies and terms, which you are encouraged to review.

We are not responsible for the actions or performance of these external platforms.

12. Changes to These Terms

We may revise these Terms & Conditions at any time.
Updated versions will be posted on deleontax.com with a new effective date.
Continued use of our services constitutes acceptance of the modified terms.
